自集体林权制度改革工作开展以来,我市在实现 “山定权、树定根、人定心”的基础上,不断创新举措,深化改革,极大地解放和发展了林业生产力,既守护了“绿水青山”,又造就了“金山银山”。为贯彻落实《国务院办公厅关于完善集体林权制度的意见》(国办发〔2016〕83号)和《云南省人民政府办公厅关于完善集体林权制度的实施意见》(云政办发〔2017〕119号)文件精神,巩固和扩大集体林权制度改革和国家集体林业综合改革试验示范区建设成果,更好实现“生态美、百姓富”的有机统一。经市人民政府同意,现就完善我市集体林权制度提出以下意见:

In order to implement the spirit of the "Opinions of the General Office of the State Council on Improving the Collective Forest Rights System" (Guobanfa [2016] No. 83) and the "Implementation Opinions of the General Office of the Yunnan Provincial People's Government on Improving the Collective Forest Rights System" (Yunzhengbanfa [2017] No. 119), consolidate and expand the achievements of the reform of the collective forest rights system and the construction of the national collective forestry comprehensive reform pilot demonstration zone, and better achieve the organic unity of "ecological beauty and people's wealth". With the consent of the Municipal People's Government, the following opinions are proposed to improve the collective forest rights system in our city:
(一)指导思想。以习近平新时代中国特色社会主义思想为指导,全面贯彻党的十九大精神,认真落实党中央、国务院和省委、省政府和市委关于生态文明建设以及林业改革发展的各项决策部署,坚持和完善农村基本经营制度,落实集体所有权、稳定农户承包权、放活林地经营权,切实巩固集体林权制度主体改革成果,完善集体林权制度配套改革政策,积极推进集体林权规范有序流转;推进林业供给侧结构性改革,加快培育新型林业经营主体,促进集体林业适度规模经营;加强林业信息化建设,完善社会化服务体系,不断提高集体林权管理服务水平;充分发挥集体林的生态、经济和社会效益,为把昆明市建设成为长江流域重要生态屏障、云南省生态文明建设排头兵和美丽中国典范城市作出新的更大贡献。
(1) Guiding ideology. Promote the supply side structural reform of forestry, accelerate the cultivation of new forestry management entities, and promote moderate scale operation of collective forestry; Strengthen the construction of forestry informatization, improve the socialized service system, and continuously enhance the level of collective forest rights management services; Fully leverage the ecological, economic, and social benefits of collective forests, and make new and greater contributions to building Kunming into an important ecological barrier in the Yangtze River Basin, a pioneer in ecological civilization construction in Yunnan Province, and a model city for beautiful China.
(二)基本原则。坚持农村林地集体所有制,巩固集体林地家庭承包基础性地位,加强农民财产权益保护;坚持尊重林农意愿,确保林农的知情权、参与权和决策权;坚持生态、经济和社会效益相统一,不断强化科技创新驱动,开发利用集体林业多种功能,实现提质、增效和增绿;坚持发挥市场在资源配置中的决定性作用和更好发挥政府作用,充分调动社会资本发展集体林业的积极性,发展特色和新兴产业,增强林业发展活力。
(2) Basic principles. Adhere to the collective ownership of rural forest land, consolidate the fundamental position of collective forest land household contracting, and strengthen the protection of farmers' property rights and interests; Adhere to respecting the wishes of forest farmers, ensuring their right to information, participation, and decision-making; Adhere to the unity of ecological, economic, and social benefits, continuously strengthen the drive of technological innovation, develop and utilize various functions of collective forestry, and achieve quality improvement, efficiency enhancement, and greening; Adhere to the decisive role of the market in resource allocation and better leverage the role of the government, fully mobilize the enthusiasm of social capital to develop collective forestry, develop characteristic and emerging industries, and enhance the vitality of forestry development.
(三)目标任务。到2020年,全市集体林业良性发展机制基本形成,产权保护更加有力,承包权更加稳定,经营权更加灵活,集体林权流转和林权抵押贷款制度更加健全,林业支持保障政策措施更加全面,管理服务体系更加完善,林业可持续发展机制更加稳固。实现森林资源持续增长、森林生态安全得到保障、林产业健康发展、林农持续稳定受益的总目标。
(3) Target task. By 2020, a sound development mechanism for collective forestry in the city will have been basically formed, with stronger property rights protection, more stable contracting rights, more flexible management rights, a more sound system for collective forest rights transfer and forest rights mortgage loans, more comprehensive forestry support and guarantee policies and measures, a more complete management service system, and a more stable mechanism for sustainable forestry development. The overall goal is to achieve sustained growth of forest resources, guarantee of forest ecological security, healthy development of the forest industry, and sustained and stable benefits for forest farmers.
(一)进一步明晰产权。尚未明晰产权的集体林地,要制定方案,明晰产权,勘界发证;通过“林帮手APP”和市级林业信息平台比对、认证等方式对全市林权及林木权登记发证情况进行认证核实,已承包到户但未发放权证的集体林地,要将权证发放到户,由农户持有;采取联户承包的集体林地,如能拆分到户的,要将林权确权颁证到户,无法拆分到户的,要将林权份额量化到户,发放股权证,建立股份合作经营机制;仍由农村集体经济组织统一经营管理的林地,要依法将股权量化到户、股权证发放到户、收益落实到户,促进发展多种形式的股份合作。退耕还林地、新造林地等要依法确权登记颁证。对存在错、重、漏登记发证的,各级有关部门要本着实事求是、有错必纠的原则,稳妥处理,做到发现一起,纠正一起。〔责任单位:各县(市)区人民政府、开发(度假)园区管委会,市林业局、市国土资源局、市农业局等部门〕

If it cannot be divided into households, the forest rights share should be quantified to households, equity certificates should be issued, and a mechanism for cooperative operation should be established; Forest land that is still managed and operated by rural collective economic organizations must quantify equity to households, issue equity certificates to households, and implement income to households in accordance with the law, promoting the development of various forms of shareholding cooperation. The conversion of farmland to forest land and the construction of new forest land must be legally registered and certified. For those who have errors, duplicates, or omissions in registration and certification, relevant departments at all levels should adhere to the principle of seeking truth from facts and correcting mistakes, handle them prudently, and ensure that every discovery is corrected. (二)放活经营权。完善商品林、公益林分类管理制度,简化区划界定方法和程序,优化林地资源配置。建立公益林动态管理机制,在不影响整体生态功能、保持公益林相对稳定的前提下,允许对承包到户的公益林进行调整完善。简化林业行政审批环节和手续,明确禁止性和限制性行为,减少政府对集体林微观生产经营行为的管制,充分释放市场活力。林业主管部门要采用信息化手段将集体林权与林地保护利用规划、造林、森林防火及森林病虫害防治等落实到山头地块,加强森林经营方案编制的培训和推进力度,逐步扩大森林经营方案编制的覆盖范围,完善森林经营措施,提升森林质量。完善全市林业管理“一张图”,向社会公示并提供查询服务。进一步改进集体人工用材林管理,赋予林业生产经营主体更大的生产经营自主权,充分调动社会资本投入集体林开发利用。〔责任单位:各县(市)区人民政府、开发(度假)园区管委会,市林业局、市财政局、市工业和信息化委、市国土资源局、市环境保护局、市金融办等部门〕
(2) Release the right to operate. Improve the classification and management system of commercial forests and public welfare forests, simplify the methods and procedures of zoning definition, and optimize the allocation of forest resources. Establish a dynamic management mechanism for public welfare forests, allowing for adjustments and improvements to public welfare forests contracted to households without affecting overall ecological functions and maintaining relative stability. Simplify the forestry administrative approval process and procedures, clarify prohibited and restrictive behaviors, reduce government regulation on micro production and operation of collective forests, and fully unleash market vitality. The forestry authorities should use information technology to implement collective forest rights and forest land protection and utilization planning, afforestation, forest fire prevention, and forest pest and disease prevention and control on hilltop plots, strengthen training and promotion of forest management plan preparation, gradually expand the coverage of forest management plan preparation, improve forest management measures, and enhance forest quality. Improve the city's forestry management "one map", publicize it to the society and provide query services. Further improve the management of collective artificial timber forests, empower forestry production and operation entities with greater autonomy in production and operation, and fully mobilize social capital to invest in the development and utilization of collective forests. (三)落实处置权。集体林权可采取转包、出租、互换、转让、入股、抵押或作为出资、合作条件及法律法规允许的方式流转。区划界定为公益林的林地、林木暂不进行转让,允许以转包、出租、入股等方式流转,在保证公益林性质不变的前提下,鼓励利用公益林发展林下经济及非木质产业。流转意愿、价格、期限、方式、对象等应由林权权利人依法自主决定。〔责任单位:各县(市)区人民政府、开发(度假)园区管委会,市林业局、市财政局、市国土资源局、市农业局等部门〕
(3) Implement disposal rights. Collective forest rights can be transferred through subcontracting, leasing, exchanging, transferring, investing, mortgaging, or as a condition for investment and cooperation, as permitted by laws and regulations. Forest land and trees designated as public welfare forests are temporarily not subject to transfer, and are allowed to be transferred through subcontracting, leasing, equity investment, and other means. While ensuring the unchanged nature of public welfare forests, the use of public welfare forests is encouraged to develop agroforestry and non timber industries. The intention, price, deadline, method, and target of transfer should be independently determined by the forest rights holder in accordance with the law. (四)保障收益权。进一步落实集体林地所有权、承包权、经营权分置运行机制,建立林地经营权管理制度,总结国家集体林业综合改革试验示范区建设成果和经验,积极宣传推广林下经营权证、林木权证确权发证先进经验。进一步规范和完善林木权登记颁证制度,简化审批流程、缩短办证时限,积极开展林木权抵押贷款和流转工作。依法保障林权权利人合法权益,任何单位和个人不得禁止或限制林权权利人依法开展经营活动。因国家公园、自然保护区、森林公园等自然保护地及野生动物重要栖息地、野生植物重要分布区等生态保护需要的,可探索采取市场化及政府赎买等方式对林权权利人给予合理补偿,着力破解生态保护与林权权利人间的利益矛盾。在承包期内,农村集体经济组织不得强行收回农业转移人口的承包林地,依法保障农业转移人口林地承包经营权及收益。集体林权被依法征收、征用的,林权权利人有权依法获得补偿。建设项目使用林地的,应当依法足额支付林地补偿费、安置补助费、地上附着物和林木补偿费等费用。对于永久占用的林权若全部占用的,原权证应予收回并注销;若占用部分的应收回权证并重新核换发权证。完善公益林补偿机制,根据地方经济发展实际,逐步提高公益林补偿标准,探索建立“谁受益、谁补偿”的多渠道补偿标准。公益林补偿资金要按时、足额发放到林权权益人手中。〔责任单位:各县(市)区人民政府、开发(度假)园区管委会,市林业局、市财政局、市国土资源局、市农业局、市金融办等部门〕
(4) Protect the right to income. Further implement the separation and operation mechanism of collective forest land ownership, contracting rights, and management rights, establish a management system for forest land management rights, summarize the achievements and experiences of the construction of national collective forestry comprehensive reform pilot demonstration zones, actively promote and publicize advanced experience in the certification and issuance of forest management rights certificates and tree ownership certificates. Further standardize and improve the registration and certification system for forest rights, simplify the approval process, shorten the time limit for certificate issuance, and actively carry out forest rights mortgage loans and transfer work. Protect the legitimate rights and interests of forest rights holders in accordance with the law, and no unit or individual shall prohibit or restrict forest rights holders from carrying out business activities in accordance with the law. Due to the ecological protection needs of natural reserves such as national parks, nature reserves, and forest parks, as well as important habitats for wildlife and important distribution areas for wild plants, it is possible to explore the use of market-oriented and government redemption methods to provide reasonable compensation to forest rights holders, and focus on resolving the conflict of interests between ecological protection and forest rights holders. During the contract period, rural collective economic organizations shall not forcibly reclaim the contracted forest land of agricultural transfer population, and shall guarantee the contracted management rights and income of agricultural transfer population's forest land in accordance with the law. If collective forest rights are lawfully expropriated or requisitioned, the forest rights holders have the right to obtain compensation in accordance with the law. If forest land is used for construction projects, compensation fees for forest land, resettlement subsidies, and compensation fees for aboveground attachments and trees shall be fully paid in accordance with the law. If all permanently occupied forest rights are occupied, the original rights should be revoked and cancelled; If a portion is occupied, the ownership certificate should be revoked and reissued. Improve the compensation mechanism for public welfare forests, gradually raise the compensation standards for public welfare forests based on local economic development, and explore the establishment of multi-channel compensation standards for "who benefits, who compensates". The compensation funds for public welfare forests should be distributed to forest rights holders on time and in full. (一)积极稳妥推进集体林地林木流转。严格界定林权流转范围,切实维护林权流转秩序。林地使用权、林木所有权、林木使用权可流转给个人、企业或其他经济组织,流转时间不能超过承包期的剩余年限。鼓励和引导农户在公益性交易平台发布信息、公开交易。集体统一经营管理的林权,流转前要进行森林资源资产评估,流转方案应在本村集体经济组织内提前公示,依法经三分之二以上村民或村民代表同意,在省、市林权公共交易平台发布信息,规范交易,坚决防止暗箱操作。创新流转和经营方式,引导各类生产经营主体开展联合、合作经营。积极引导工商资本投资林业,依法、合理开发利用林地林木,参与国家储备林建设。加强对工商资本流转林权的事中事后监管,建立流转条件、用途、经营计划备案制度。对规范经营、提高林地产出、促进农户增收的企业,符合有关补助政策要求的,按照规定给予政策支持和资金补助。涉林权流转的企业信用记录向社会公开。完善全市林权管理及林权交易信息系统,加快全市林业社会化服务体系建设。林权流转不能搞强迫命令,不能违背承包农户意愿,不能损害农民权益,不能改变林地性质和用途。〔责任单位:各县(市)区人民政府、开发(度假)园区管委会,市林业局、市财政局、市国土资源局、市农业局、市工商局等部门〕

The transfer plan should be publicly announced within the village's collective economic organization in advance, and with the consent of more than two-thirds of the villagers or village representatives in accordance with the law, information should be published on the provincial and municipal forest rights public trading platforms to standardize transactions and resolutely prevent covert operations. Innovate circulation and management methods, guide various production and operation entities to carry out joint and cooperative operations. Actively guide industrial and commercial capital to invest in forestry, lawfully and reasonably develop and utilize forest land and trees, and participate in the construction of national reserve forests. Strengthen the in-process and post process supervision of industrial and commercial capital transfer of forest rights, establish a system for recording transfer conditions, purposes, and business plans. For enterprises that standardize their operations, increase forest output, and promote farmers' income growth, and meet the requirements of relevant subsidy policies, policy support and financial subsidies will be provided in accordance with regulations. The credit records of enterprises involved in the transfer of forest rights shall be made public to the society. Improve the city's forest rights management and forest rights trading information system, and accelerate the construction of the city's forestry socialized service system. The transfer of forest rights cannot involve forced orders, cannot go against the wishes of contracted farmers, cannot harm the rights and interests of farmers, and cannot change the nature and use of forest land. (二)完善林木采伐管理制度。全面推行集体林采伐公示制度,林业部门要及时公示林木采伐指标分配情况。大力推进实施森林可持续经营,培育大径级材,提高林地产出率。积极指导新型林业经营主体编制并实施森林经营方案,其培育的短轮伐期用材林,主伐年龄自主确定,在确保及时更新的前提下,可由经营主体自主确定采伐时间,并在编限单位年森林采伐限额内优先安排采伐指标。〔责任单位:各县(市)区人民政府、开发(度假)园区管委会,市林业局等部门〕

(三)发展适度规模经营。扶持培育新型林业经营主体,采取多种方式兴办家庭林场、联营林场、股份合作制林场等,逐步扩大其承担的涉林项目规模。鼓励各县(市)区人民政府、开发(度假)园区管委会开展林业适度规模生产经营主体带头人和职业森林经理人培训行动。加快林业结构调整,充分发挥林业多种功能,以生产绿色生态林产品为导向,大力发展林下经济、特色经济林、木本油料、特色乡土树种、苗木花卉、竹藤等特色产业,大力发展新技术新材料、森林生物制药、森林旅游休闲康养等绿色新兴产业。鼓励林业碳汇项目产生的减排量参与温室气体自愿减排交易,促进碳汇进入碳排放交易市场。加强林业品牌创建,开展公益宣传活动,引导生产经营主体面向市场加快发展。开展林特产品标准化生产示范,把林特小品种做成带动农民增收的大产业。鼓励工商资本与农户开展股份合作经营,推进农村一二三产业融合发展,带动农户从涉林经营中受益。开展宜良县“林木权证电子交易平台”及苗木期权交易市场建设试点;加快构建以市级为中心,各县(市)区人民政府、开发(度假)园区管委会优势林产业为支撑的苗木、木材产品、家具、物流信息综合服务体系。〔责任单位:各县(市)区人民政府、开发(度假)园区管委会,市林业局、市发展改革委、市财政局、市农业局、市科技局、市供销社等部门〕
(3) Develop moderate scale operations. Vigorously develop characteristic industries such as understory economy, characteristic economic forests, woody oil crops, characteristic local tree species, seedlings, flowers, bamboo and rattan, and vigorously develop new technologies and materials, forest biopharmaceuticals, forest tourism, leisure and health care, and other green emerging industries. Encourage the emission reductions generated by forestry carbon sequestration projects to participate in voluntary greenhouse gas emission reduction trading, and promote the entry of carbon sinks into the carbon emission trading market. Strengthen the creation of forestry brands, carry out public welfare propaganda activities, and guide production and operation entities to accelerate their development towards the market. Carry out standardized production demonstrations of Linte products and turn Linte small varieties into a large-scale industry that drives farmers' income growth. Encourage industrial and commercial capital to engage in joint-stock cooperative operations with farmers, promote the integrated development of the primary, secondary, and tertiary industries in rural areas, and drive farmers to benefit from forest management. Carry out pilot projects for the construction of the "Electronic Trading Platform for Forest Rights Certificates" and the Nursery Stock Option Trading Market in Yiliang County; Accelerate the construction of a comprehensive service system for nursery stock, wood products, furniture, and logistics information centered on the city level, supported by the advantageous forest industry of the people's governments of each county (city) district and the management committees of development (vacation) parks.
